1. Operator, Scope and Acceptance

WeddingPeer.com ("WeddingPeer", "Platform", "we", "us", or "our") is operated by:

These Terms of Service ("Terms") govern access to and use of WeddingPeer.com and its associated services, features, listings and communication tools.

By registering an account, publishing a listing, or otherwise expressly accepting these Terms, you agree to be bound by them. If you do not agree, you must not use features requiring acceptance of these Terms.

These Terms govern your relationship with WeddingPeer. Transactions between users are separate agreements to which WeddingPeer is not a party.

2. Nature of the Platform

WeddingPeer is exclusively an online classifieds and advertising platform. It allows users to advertise, discover and communicate about wedding-related products, including wedding dresses, clothing, accessories, decorations and other permitted items.

WeddingPeer does not sell, purchase, rent, own, possess, inspect or deliver any advertised products.

WeddingPeer is not a party to any transaction between users and does not act as a seller, buyer, rental provider, intermediary, broker, agent or representative.

In particular, WeddingPeer does not:

• Process, receive, hold or transfer transaction payments.
• Provide escrow services or payment guarantees.
• Offer buyer or seller protection.
• Guarantee delivery, authenticity, quality or availability.
• Inspect or verify the physical condition of products.
• Arrange shipping, collection, cleaning or returns.
• Provide insurance or transaction financing.
• Guarantee performance of agreements between users.
• Administer refunds or compensation for user transactions.

Any purchase, sale, rental or other arrangement is concluded directly between the participating users, independently of WeddingPeer.

Nothing in this section excludes obligations imposed directly on WeddingPeer by applicable mandatory law.

3. Eligibility and User Accounts

Users must be at least 18 years old, have reached the age of legal majority in their jurisdiction and possess the legal capacity necessary to enter into relevant agreements.

Users agree to provide accurate and current registration information and to keep their login credentials secure.

Users must not impersonate other persons, provide materially misleading identity information or create accounts to circumvent restrictions or suspensions.

Users are responsible for activities they authorise through their accounts and for losses resulting from a failure to take reasonable security precautions, subject to applicable law. Users are not automatically responsible for unauthorised access beyond their control.

WeddingPeer may restrict or suspend accounts in accordance with Section 11 of these Terms.

4. Private and Commercial Sellers

WeddingPeer may be used by private individuals and commercial sellers, subject to applicable law and Platform requirements.

Users must accurately represent whether they are acting privately or in the course of a trade, business or profession.

Commercial sellers are solely responsible for compliance with all laws applicable to their commercial activities, including:

• Consumer protection and distance-selling regulations.
• Mandatory pre-contractual information requirements.
• Product safety and labelling obligations.
• Warranty and statutory consumer remedies.
• Applicable cancellation and withdrawal rights.
• Tax reporting, VAT and customs obligations.
• Advertising and unfair competition laws.
• Business registration and identification requirements.

Commercial sellers must not misrepresent themselves as private individuals to avoid legal obligations.

WeddingPeer does not assume the legal obligations of commercial sellers merely by hosting their advertisements. Mandatory duties imposed directly on WeddingPeer remain unaffected.

5. Listings and Advertisements

Users are solely responsible for the advertisements, photographs, descriptions, prices and other information they publish.

By publishing a listing, a user represents that:

• They own the advertised item or are legally authorised to offer it.
• The listing is accurate, lawful and not materially misleading.
• Any relevant defects, damage, alterations or limitations are adequately disclosed.
• The photographs accurately represent the item unless clearly identified as illustrative.
• They have the necessary rights to all uploaded content.
• The item may legally be offered in the relevant jurisdictions.

Wedding dress sizes, measurements, colours, materials and conditions may vary. Previous alterations may affect fit. Buyers are responsible for carrying out reasonable checks before entering into a transaction.

Users must promptly update or remove listings that are no longer accurate or where an item is no longer available.

WeddingPeer does not guarantee that listings are accurate, complete, authentic, current or legally compliant.

6. Transactions Between Users

All transactions are undertaken entirely at the participating users' own commercial and contractual risk, subject to their applicable legal rights.

Users are independently responsible for negotiating and agreeing the conditions of their transactions, including:

• Purchase or rental prices and currencies.
• Payment methods and payment deadlines.
• Shipping, collection and delivery arrangements.
• Customs, taxes and additional charges.
• Item condition and authenticity.
• Insurance and allocation of risk.
• Cancellation, returns and refunds.
• Rental duration, deposits, cleaning and damage.
• Applicable warranties and contractual remedies.

WeddingPeer does not collect payments on behalf of users and does not guarantee reimbursement if a transaction is unsuccessful.

Users should independently verify information, exercise appropriate caution and retain records of their agreements.

Any transaction dispute must ordinarily be addressed directly between the contracting users or through the relevant payment provider, delivery provider or competent legal authority.

WeddingPeer is under no contractual obligation to mediate or resolve disputes between users, recover payments or enforce their agreements, except where applicable law requires otherwise.

7. Prohibited Content and Activities

Users must not:

• Publish fraudulent, false or materially misleading listings.
• Advertise stolen, counterfeit, illegal or prohibited goods.
• Infringe intellectual property or privacy rights.
• Impersonate another individual or business.
• Engage in scams, phishing or deceptive payment requests.
• Harass, threaten or unlawfully discriminate against users.
• Distribute malware or attempt unauthorised system access.
• Manipulate ratings, reviews or listing visibility.
• Send spam or unsolicited commercial communications.
• Collect personal data without a lawful basis.
• Scrape or systematically extract substantial amounts of Platform data without permission, except where permitted by mandatory law.
• Use the Platform for activities that violate applicable laws.

WeddingPeer may take appropriate action against violations in accordance with applicable moderation and notice rules.

8. User Content and Intellectual Property

Users retain ownership of the content they upload, subject to rights held by third parties.

By submitting publicly visible content, users grant WeddingPeer a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, distribute and technically adapt that content as reasonably necessary to provide and operate the Platform.

This includes displaying listings in search results, supporting normal search-engine indexing and technically optimising images for compatible devices.

Users represent that they possess all necessary permissions for their content, including rights to photographs, trademarks and identifiable images of individuals.

The licence generally ends when the relevant content is removed, subject to lawful retention, backups, dispute handling and copies independently retained by third parties.

This licence does not permit WeddingPeer to sell user photographs for unrelated purposes or publicly disclose private messages.

WeddingPeer's own branding, software, designs and original content remain the property of WeddingPeer or its licensors.

9. No Verification or Endorsement

Publication of a listing does not constitute verification, certification, endorsement or approval by WeddingPeer.

Unless expressly stated otherwise for a particular feature, WeddingPeer does not independently verify:

• Users' identities or legal capacity.
• Ownership of advertised items.
• Authenticity of brands or products.
• Physical condition or safety of items.
• Accuracy of photographs and descriptions.
• Financial reliability or intentions of users.

Any verification badge or indicator, if offered, relates only to the specific verification process explicitly described for that feature and does not constitute a general transaction guarantee.

Ratings, reviews and user opinions are those of their authors and do not necessarily represent WeddingPeer's views.

10. Content Moderation and Reporting

Users and third parties may report suspected unlawful content, fraud, intellectual property infringement or violations of these Terms through the reporting features available on the Platform or the contact details in Section 21.

Reports should identify the content concerned, explain the alleged violation and provide sufficient supporting information for an assessment.

WeddingPeer may investigate reports and, where justified, remove listings, restrict content visibility, request corrections or suspend accounts.

Moderation decisions may take account of the nature and seriousness of the issue, reliability of supporting information, user rights and applicable legal obligations.

Where required by law, WeddingPeer will provide reasons for moderation decisions and information about available complaint or review procedures.

Users may request reconsideration of a moderation decision using the contact information provided below.

WeddingPeer does not undertake to examine every listing before publication. This does not affect any monitoring, notice-and-action or removal duties imposed by law.

11. Account Suspension and Termination

WeddingPeer may restrict, suspend or terminate access where reasonably necessary because of:

• Material breaches of these Terms.
• Suspected fraud or unlawful conduct.
• Security risks or unauthorised activities.
• Infringement of third-party rights.
• Applicable legal or regulatory requirements.

Any action will be taken proportionately and with the notice, explanation and opportunity for review required by applicable law.

Immediate restrictions may be imposed where necessary to address urgent legal or security risks.

Users may request account closure at any time. Account closure does not cancel existing agreements between users or extinguish accrued legal obligations.

Where applicable platform-to-business legislation requires advance notice of termination for a commercial user, WeddingPeer will observe the required notice periods and any applicable exceptions.

12. Platform Availability

WeddingPeer aims to provide a reliable service but does not guarantee uninterrupted or error-free availability.

The Platform may occasionally be unavailable due to maintenance, technical failures, security incidents, infrastructure issues or circumstances beyond our reasonable control.

WeddingPeer may modify, improve or discontinue features, subject to applicable legal and contractual obligations.

Users are encouraged to retain independent copies of important transaction-related communications and information.

13. Disclaimers of Warranties

To the maximum extent permitted by applicable law, the Platform is provided on an "as is" and "as available" basis, without additional express or implied warranties.

Subject to mandatory law and any express commitments made by WeddingPeer, we make no guarantee concerning:

• Accuracy or completeness of user-generated listings.
• Authenticity, ownership, safety or condition of items.
• Reliability, honesty or conduct of other users.
• Successful completion of any transaction.
• Payment, delivery, return or refund of products.
• Suitability of products for any particular purpose.
• Continuous availability or error-free operation.
• Sales results, enquiries, exposure or listing performance.

Users acknowledge that online classified transactions involve risks and that independent checks are advisable.

Nothing in this section excludes liability for WeddingPeer's own conduct where applicable law does not permit such an exclusion.

14. Limitation of Liability

WeddingPeer excludes and limits liability to the fullest extent permitted by applicable law.

In particular, WeddingPeer is not responsible for losses arising solely from the acts or omissions of other users, including:

• Fraudulent or misleading advertisements.
• Non-payment or payment disputes.
• Non-delivery, late delivery or loss of goods.
• Counterfeit, defective or misdescribed products.
• Rental damage or failure to return rented items.
• Disagreements concerning refunds or cancellations.
• Failure of an item to arrive before a wedding or event.
• Contractual disputes between buyers and sellers.

This allocation of responsibility does not exclude liability arising from WeddingPeer's own breach of a legal duty.

For users acting in a business capacity, to the extent permitted by law, WeddingPeer excludes liability for ordinary negligence and for indirect or consequential damages, lost profits, lost revenues, lost opportunities and loss of goodwill.

For consumers, WeddingPeer remains responsible for losses arising from its own breach to the extent required by applicable consumer protection and other mandatory laws.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury where liability cannot lawfully be excluded, or any other liability that cannot be excluded or limited under applicable law.

All exclusions and limitations apply only to the extent legally enforceable. Mandatory consumer rights, statutory guarantees and remedies remain unaffected.

15. Indemnification by Business Users

Users acting for business purposes agree, to the extent permitted by applicable law, to indemnify WeddingPeer against reasonable and documented third-party claims, losses and legal expenses to the extent caused by their culpable unlawful conduct, infringement of third-party rights or material breach of these Terms.

This obligation does not cover losses attributable to WeddingPeer's own conduct or liability that cannot lawfully be transferred.

WeddingPeer will provide reasonable notice of relevant claims and allow appropriate participation in their defence.

This contractual indemnification obligation does not apply to consumers. Consumer liability is governed by applicable law.

16. Privacy and Personal Data

WeddingPeer processes personal data in accordance with its Privacy Policy and applicable data protection laws, including the Swiss Federal Act on Data Protection and, where applicable, the European Union General Data Protection Regulation.

Users should avoid publishing sensitive personal information in public listings.

Users who receive another person's contact information must use it only for lawful purposes, including legitimate transaction-related communications.

Commercial users are independently responsible for complying with applicable data protection requirements when processing personal data received through the Platform.

Details concerning data collection, storage, retention, sharing and user rights are provided in the separate Privacy Policy.

17. International Use

WeddingPeer may be accessed internationally, but does not represent that all advertised goods, services or transactions are lawful or suitable in every jurisdiction.

Users are responsible for ensuring that their activities comply with all applicable local, national and international laws, including customs, import and export restrictions, sanctions, taxes, product safety and consumer protection.

International shipping, customs declarations, import duties and related responsibilities must be arranged by the contracting users.

WeddingPeer does not act as importer, exporter, customs representative or tax agent for transactions between users.

18. Changes to the Terms

WeddingPeer may amend these Terms for legitimate reasons, including changes in legislation, security requirements, technical functionality or Platform operations.

Material changes will be communicated to affected registered users in advance through an appropriate channel.

WeddingPeer will normally provide at least 30 days' notice of material changes, unless a shorter period is permitted by law and justified by urgent circumstances.

Where platform-to-business legislation applies, its specific notice periods and requirements will be respected, including notice on a durable medium and longer periods where legally required.

Changes will not retroactively remove rights already accrued or modify concluded transactions between users.

Where applicable law requires renewed acceptance, WeddingPeer will request it before the changes become binding on the relevant user.

19. Governing Law and Jurisdiction

These Terms are governed by the substantive laws of Switzerland to the extent that a choice of law is legally permitted.

For business users, the competent courts at the operator's address in Hinteregg, Canton of Zurich, Switzerland, have exclusive jurisdiction to the extent permitted by applicable law.

For consumers, this choice of law and jurisdiction does not deprive them of mandatory consumer protections or legally protected rights to bring proceedings in their country of residence or another competent forum.

Nothing in these Terms excludes mandatory rules governing jurisdiction, choice of law or consumer dispute resolution.

This section applies to disputes involving WeddingPeer and does not determine the applicable law or jurisdiction of independent transactions between users.

20. General Provisions

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in effect to the extent legally permissible.

Failure by WeddingPeer to enforce a provision does not automatically constitute a waiver of its rights.

Provisions concerning accrued obligations, intellectual property, applicable liability limitations and dispute resolution survive account termination to the extent necessary and legally enforceable.

The English version is the reference version of these Terms unless mandatory law or an express agreement requires otherwise.

These Terms do not restrict or exclude any rights that cannot lawfully be waived.
