Important notice regarding WeddingPeer’s role:
WeddingPeer is solely a technical online platform for the publication of listings, user discovery, contact initiation, and communication between users. WeddingPeer is not a lessor, lessee, seller, buyer, broker, intermediary, agent, insurer, payment service provider, bailee, escrow provider, trustee, or other contracting party to any transaction between users.
No rental, sale, service, or other contract between users is concluded through WeddingPeer itself, unless WeddingPeer expressly states otherwise in writing.
By creating an account, accessing the platform, or using WeddingPeer, you agree to be bound by these Terms of Use (the “Terms”).
1. Definitions
In these Terms:
“WeddingPeer” / “we” / “us” / “our” means the operator of the WeddingPeer.com platform identified above.
“Platform” means the website, mobile website, apps, communication features, content, software, and services provided by WeddingPeer.
“User” means any person or entity visiting or using the Platform.
“Provider” means a User who lists, offers, or makes available an item for rental, use, or similar arrangement.
“Requester” means a User who contacts a Provider or expresses interest in a listing.
“Item” means any item listed by a User, including dresses, accessories, and similar goods.
“User Content” means listings, text, images, messages, reviews, documents, data, or other content provided by Users.
“Third-Party Services” means services provided by third parties, including email, hosting, communications, payment, insurance, identity, analytics, or security services.
2. Purpose of the Platform
2.1 WeddingPeer provides technical infrastructure through which Users may:
publish listings,
view listings,
contact other Users,
exchange messages,
exchange information regarding Items and conditions.
2.2 WeddingPeer does not itself offer any Items for rent or sale and does not carry out the operational performance of transactions between Users.
2.3 WeddingPeer may provide features that facilitate communication or organization between Users. Such features do not alter WeddingPeer’s role as a neutral technical platform.
2.4 To the extent WeddingPeer provides templates, guidance, example text, safety information, or other tools, these are provided solely for general information and convenience. They do not constitute legal advice, a representation, or an assumption of any contractual or statutory obligation by WeddingPeer.
3. No Contracts Concluded Through the Platform; No Broker or Intermediary Role
3.1 WeddingPeer is not a party to any transaction between Users.
3.2 Use of the Platform, publication of a listing, contact initiation, exchange of messages, display of status messages, use of buttons such as “Send Request,” “Express Interest,” or similar technical functions, or any other interaction through the Platform shall not by itself create any contract between Users and, in particular, shall not create any contract with WeddingPeer concerning any listed Item.
3.3 Any contract concerning an Item, if one is entered into at all, is entered into solely and directly between the relevant Users and only upon their independent, express agreement beyond the mere technical use of the Platform. WeddingPeer is not involved in such contract and does not become a party to it.
3.4 WeddingPeer does not act as a broker, intermediary, agent, representative, merchant, reseller, dealer acting in its own name, franchisee, commission agent, insurer, guarantor, or trustee.
3.5 WeddingPeer does not, in particular, owe or undertake:
the conclusion of any contract,
the availability of any Item,
the performance, fulfillment, or enforceability of any contract,
the handover or return of any Item,
the payment or refund of any amounts,
the provision, custody, or release of any deposit,
the adjustment of damages,
dispute resolution between Users,
verification of the legal permissibility of any User transaction.
3.6 Users expressly acknowledge that WeddingPeer acts solely as the provider of technical infrastructure and does not assume economic or legal responsibility for transactions between Users.
4. Eligibility; International Use
4.1 You may use the Platform only if you are at least 18 years old, legally competent, and able to enter into binding agreements under applicable law.
4.2 If you use the Platform on behalf of a legal entity, organization, or business, you represent and warrant that you are duly authorized to do so.
4.3 You are solely responsible for ensuring that your use of the Platform, your listings, your communications, and any agreement you may enter into with another User are lawful in your country, the other User’s country, and any other relevant jurisdiction.
4.4 WeddingPeer makes no representation that the Platform or its content is lawful, appropriate, or available in any particular jurisdiction.
5. Registration, Accounts, and Security
5.1 Certain features require an account.
5.2 You must provide accurate, complete, and current information when registering and must keep such information up to date.
5.3 You are responsible for all activity conducted through your account unless you can demonstrate that unauthorized use occurred despite appropriate security measures on your part.
5.4 You must keep your login credentials confidential and promptly notify WeddingPeer if you suspect unauthorized access or misuse.
5.5 WeddingPeer may suspend, restrict, or terminate accounts, in its reasonable discretion, where there are indications of violations of these Terms, unlawful conduct, security risks, deception, misuse, or reputational risk.
6. No Verification, Screening, or Guarantee
6.1 WeddingPeer is not required, and does not generally undertake, to verify, monitor, or guarantee:
the identity of Users,
the creditworthiness of Users,
ownership of, or authority over, any Item,
the authenticity, quality, safety, or legality of any Item,
the accuracy or completeness of listings,
the ability, solvency, or reliability of any User,
the suitability of an Item for a particular purpose,
compliance by Users with local laws,
ratings, references, or statements made by Users.
6.2 Even if WeddingPeer voluntarily conducts certain checks, requests information, applies labels, performs moderation, or provides notices, this shall not create any general duty of verification, representation, warranty, or assumption of liability.
6.3 Users interact and transact solely at their own risk.
7. General User Responsibilities
7.1 Users are solely responsible for:
carefully evaluating the other party,
deciding whether and on what terms to enter into any agreement,
independently negotiating and documenting all material terms of any transaction,
verifying the identity, authority, and reliability of the other party,
verifying the condition, fit, suitability, availability, and ownership status of any Item,
entering into a separate written agreement if they consider it appropriate,
arranging insurance, deposits, taxes, shipping, handover, return, cleaning, repair, and liability issues independently.
7.2 Users may use the Platform only in compliance with these Terms and all applicable laws.
7.3 Users must not infringe the rights of third parties, including property, trademark, copyright, personality, privacy, data protection, or consumer rights.
8. Provider Obligations
As a Provider, you represent, warrant, and agree that:
8.1 You are legally entitled to list the Item and to offer any rental, use, or other arrangement related to it.
8.2 Your listings are accurate, not misleading, and sufficiently complete.
8.3 Descriptions, images, sizing information, condition details, wear and tear, damage, defects, accessories, availability, and other material information are truthful and accurate.
8.4 You will not list counterfeit, stolen, unlawful, dangerous, unsafe, or third-party rights-infringing Items.
8.5 You will comply with all laws applicable to you, including information, labeling, safety, consumer, tax, customs, and registration requirements.
8.6 Where legally required, you will clearly and truthfully disclose whether you are acting as a business / trader or as a private individual.
8.7 You alone are responsible for performing any obligations you agree upon with another User.
9. Requester / Rental Interest Obligations
As a Requester or interested User, you represent, warrant, and agree that:
9.1 You will provide truthful information to other Users.
9.2 You will use any Item only in accordance with what has been agreed with the other User.
9.3 You owe any agreed amounts, deposits, shipping charges, repair costs, cleaning fees, or other charges exclusively to the other User, to the extent and once such an agreement has validly been entered into.
9.4 You will not sub-rent, sell, alter, misuse, or transfer any Item to third parties unless expressly agreed with the Provider.
9.5 You will comply with applicable laws and third-party rights.
10. Listings, Messages, and User Content
10.1 Users are solely responsible for their User Content.
10.2 You must not upload, post, send, or otherwise make available any content that is:
false, misleading, or fraudulent,
related to unlawful goods, services, or activities,
abusive, threatening, discriminatory, obscene, or rights-infringing,
containing malware, harmful code, or unlawful tracking technologies,
harmful to the security or integrity of the Platform,
generated or distributed in an abusive automated manner,
in violation of third-party rights.
10.3 WeddingPeer may, but is not obliged to, review, moderate, restrict, label, hide, or remove User Content where WeddingPeer reasonably believes that such content violates these Terms, applicable law, third-party rights, or may endanger the Platform, Users, or third parties.
10.4 WeddingPeer is not obliged to pre-screen User Content or actively seek unlawful content unless required by applicable law.
10.5 WeddingPeer may provide mechanisms through which unlawful or Terms-violating content can be reported. Users must make such reports truthfully and to the best of their knowledge.
10.6 WeddingPeer may take measures in cases of repeated misuse, repeatedly manifestly unfounded notices, repeated violations, fraud, or other abuse, including warnings, reduced visibility, content removal, account suspensions, or permanent bans.
11. License to User Content
11.1 You retain your rights in your User Content, unless otherwise agreed between you and WeddingPeer.
11.2 You grant WeddingPeer a worldwide, non-exclusive, sublicensable, transferable, royalty-free license to host, store, reproduce, technically modify, format, translate, display, make available to the public, distribute, and use your User Content to the extent necessary or useful for operating, improving, promoting, securing, moderating, and legally protecting the Platform.
11.3 You represent and warrant that you hold all rights necessary to grant this license.
12. Fees, Payments, and Economic Handling
12.1 Unless WeddingPeer expressly states otherwise, WeddingPeer does not itself process payments between Users and does not hold money, deposits, or other assets on behalf of Users.
12.2 All economic arrangements between Users — including price, currency, deposits, payment method, due dates, shipping charges, cleaning fees, replacement claims, and refunds — are agreed and handled exclusively between the relevant Users.
12.3 If WeddingPeer later offers optional paid platform services, listing upgrades, subscriptions, visibility products, or other proprietary services, such services will be described and billed separately. Such platform fees relate only to the relationship between WeddingPeer and the relevant User and do not make WeddingPeer a party to any User contract.
12.4 Where WeddingPeer links to, embeds, or technically supports third-party payment solutions, this is done solely as an auxiliary technical function. The respective payment provider acts independently under its own terms.
13. No Insurance; No Custody; No Responsibility for Damage
13.1 WeddingPeer does not provide insurance for Users, Items, transactions, shipping, or events unless expressly stated otherwise in writing.
13.2 WeddingPeer does not take custody of, store, physically control, or handle the transfer of any Item.
13.3 WeddingPeer assumes no responsibility for loss, theft, delayed return, damage, soiling, fit issues, personal injury, property damage, loss of use, or any other consequence arising in connection with any Item or any agreement between Users.
14. Disputes Between Users
14.1 Disputes between Users must be resolved exclusively by the Users involved.
14.2 WeddingPeer is under no obligation to investigate disputes, mediate, arbitrate, decide claims, assess evidence, order refunds, or provide compensation.
14.3 If WeddingPeer voluntarily offers communication assistance, reporting mechanisms, documentation tools, or informal moderation, this is provided purely as a courtesy and without acknowledgment of any legal duty or liability.
14.4 To the extent permitted by law, Users waive any claim against WeddingPeer for disputes or claims arising solely from the conduct of another User or from an agreement between Users that was concluded, not concluded, performed, or not performed.
15. Prohibited Use
You may not use the Platform to:
violate any law or regulatory order,
deceive others, impersonate others, or conceal identity,
provide false or manipulated information,
offer unlawful, stolen, dangerous, or prohibited Items,
engage in spam, scraping, hacking, reverse engineering, abusive automated data collection, or other technical misuse,
circumvent security measures,
distribute viruses, bots, or malicious software,
manipulate ratings or interactions,
infringe third-party rights,
collect or publish personal data of other Users without authorization,
use the Platform in a manner harmful to WeddingPeer, other Users, or third parties.
WeddingPeer may define categories of prohibited or restricted Items and conduct in separate policies.
16. Third-Party Services and External Links
16.1 The Platform may contain interfaces, content, tools, or links provided by third parties.
16.2 WeddingPeer does not control Third-Party Services and assumes no responsibility for them.
16.3 Any contracts, payments, claims, data processing, or other legal relationships with third parties exist solely between you and the respective third party.
17. Privacy
17.1 WeddingPeer’s processing of personal data is governed by the applicable Privacy Policy.
17.2 Users are themselves responsible for any data protection compliance when processing personal data received from or relating to other Users.
17.3 WeddingPeer is not responsible for how Users use personal data they obtain from other Users.
18. Intellectual Property in the Platform
18.1 The Platform and its components, including software, design, database structure, text, logos, trademarks, features, and WeddingPeer content, are protected by law.
18.2 Except as expressly permitted, you may not copy, distribute, license, decompile, commercially exploit, mirror, or otherwise use the Platform or any part of it without authorization.
18.3 WeddingPeer grants you a revocable, non-exclusive, non-transferable, non-sublicensable, limited license to use the Platform in accordance with these Terms.
19. Disclaimer of Warranties
19.1 To the fullest extent permitted by law, the Platform is provided “as is” and “as available.”
19.2 WeddingPeer makes no express or implied representations, warranties, or guarantees, including as to:
merchantability,
fitness for a particular purpose,
uninterrupted availability,
error-free operation,
security,
compatibility,
accuracy or completeness of content,
legality or suitability of User transactions,
quality, safety, title, or availability of Items,
identity, conduct, or performance of Users.
19.3 No information or statement by WeddingPeer, whether oral, written, automated, included in help text, resulting from moderation, labeling, or support, creates any warranty, representation, or assumption of liability unless WeddingPeer expressly states so in writing.
20. Limitation of Liability
20.1 To the fullest extent permitted by law, WeddingPeer shall not be liable for indirect, consequential, incidental, special, exemplary, punitive, or economic losses, including lost profits, lost revenue, lost opportunities, reputational harm, data loss, or loss of use.
20.2 To the fullest extent permitted by law, WeddingPeer shall also not be liable for any damage, loss, or claim arising out of or in connection with:
User Content,
unavailability of the Platform,
security incidents outside WeddingPeer’s reasonably controllable sphere,
acts, omissions, or statements of other Users,
the condition, quality, safety, legality, authenticity, availability, or suitability of any Item,
the conclusion, non-conclusion, performance, or non-performance of any agreement between Users,
payments, non-payments, refunds, deposits, damage, theft, loss, shipping, return, or cleaning,
measures taken by WeddingPeer in good faith for moderation, safety, compliance, or risk management.
20.3 Where liability of WeddingPeer cannot validly be excluded under applicable law, WeddingPeer’s aggregate liability, regardless of legal basis, shall be limited to the greater of:
(a) the amount paid by the relevant User directly to WeddingPeer for its own platform services during the twelve (12) months preceding the event giving rise to liability; or
(b) EUR 100.
20.4 The foregoing limitations of liability apply to the fullest extent permitted by law and also in favor of WeddingPeer’s legal representatives, directors, officers, employees, agents, contractors, affiliates, and service providers.
20.5 Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by mandatory law, including, where applicable, liability for intent, gross negligence, fraudulent misrepresentation, and, to the extent non-excludable, death or personal injury.
21. Indemnification
21.1 You agree to indemnify, defend, and hold harmless WeddingPeer, its affiliates, directors, officers, employees, representatives, and agents from and against any and all claims, demands, proceedings, liabilities, losses, damages, fines, penalties, costs, and reasonable legal fees arising out of or in connection with:
your use of the Platform,
your User Content,
your listings,
your statements or representations,
your communications or agreements with other Users,
any alleged or actual violation of law or third-party rights,
your breach of these Terms.
21.2 WeddingPeer reserves the right to assume the exclusive defense or settlement of any such matter, in which case you shall reasonably cooperate with WeddingPeer.
22. Tax, Customs, Consumer, and Other Compliance Obligations
22.1 Users are solely responsible for all tax, customs, regulatory, licensing, consumer, product, and other legal obligations applicable to them.
22.2 In particular, Providers are solely responsible for determining whether they qualify as a business / trader, whether they must provide consumer disclosures, whether withdrawal rights or other mandatory rules apply, and what information they must provide to other Users.
22.3 WeddingPeer provides no legal advice and assumes no responsibility for whether a User is classified as a business / trader or consumer, or for the consequences of such classification.
23. Reporting, Enforcement, and Cooperation with Authorities
23.1 WeddingPeer may provide mechanisms through which Users or third parties may report unlawful content, safety concerns, or breaches of these Terms.
23.2 WeddingPeer may review reported content and accounts and take appropriate measures in its reasonable discretion.
23.3 WeddingPeer may disclose information to courts, governmental authorities, regulators, law enforcement agencies, or other entitled third parties where WeddingPeer considers such disclosure necessary or appropriate under applicable law.
23.4 WeddingPeer may inform Users of restrictions, removals, suspensions, or other moderation decisions where legally required or reasonably appropriate.
24. Suspension, Termination, and Account Closure
24.1 You may close your account at any time, subject to any outstanding obligations owed to WeddingPeer.
24.2 WeddingPeer may restrict, suspend, or terminate access to the Platform or particular features, temporarily or permanently, where there is a legitimate reason, including legal violations, misuse, security risks, fraud, breaches of these Terms, technical risk, or legal requirements.
24.3 WeddingPeer is not obliged to retain data or content after termination except where required by law.
24.4 Provisions that by their nature should survive termination shall remain in effect, including those relating to liability, indemnification, intellectual property, disputes, governing law, and general provisions.
25. Changes to the Terms
25.1 WeddingPeer may amend these Terms with future effect, including in response to changes in the Platform, law, security environment, or business model.
25.2 WeddingPeer will provide notice of material changes in an appropriate manner, such as by email, via the Platform, or at the next login.
25.3 To the extent permitted by applicable law, your continued use of the Platform after the changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Platform and, if applicable, close your account.
26. Governing Law and Jurisdiction
26.1 These Terms and any non-contractual disputes or claims arising out of or in connection with these Terms or the Platform shall be governed by Swiss laws, excluding its conflict-of-laws rules and excluding the UN Convention on Contracts for the International Sale of Goods, to the extent permitted by law.
26.2 To the extent permitted by law, the courts at the registered seat of WeddingPeer shall have exclusive jurisdiction over all disputes arising out of or in connection with these Terms or the Platform.
26.3 If you are a consumer, mandatory consumer protection provisions of your country of habitual residence remain unaffected to the extent applicable and non-waivable.
26.4 Where mandatory law requires another jurisdiction or another governing law rule to apply, such mandatory rules shall prevail.
27. Language, Interpretation, and Order of Precedence
27.1 WeddingPeer may make these Terms available in multiple languages.
27.2 In the event of discrepancies between language versions, the German version shall prevail to the extent permitted by law.
27.3 Section headings are for convenience only and do not affect interpretation.
28. Severability
28.1 If any provision of these Terms is held to be invalid, void, or unenforceable in whole or in part, the remaining provisions shall remain in full force and effect.
28.2 The invalid or unenforceable provision shall be replaced, to the extent legally permissible, by a valid provision that most closely reflects the commercial intent of the original provision.
29. No Waiver; Assignment; Entire Agreement
29.1 No waiver by WeddingPeer of any provision shall be effective unless expressly made in writing.
29.2 You may not assign or transfer any rights or obligations under these Terms without WeddingPeer’s prior written consent.
29.3 WeddingPeer may assign or transfer its rights and obligations under these Terms in connection with a restructuring, financing, acquisition, merger, sale of assets, or other succession event.
29.4 These Terms, together with any additional policies expressly incorporated by reference, constitute the entire agreement between you and WeddingPeer regarding use of the Platform.
